10th Amendment

CHALLENGING THE BRADY LAW

 Brady Law forced local police agencies to perform background checks on potential gun buyers.  We challenged this on the basis of the Tenth Amendment asserting that the Constitution does not give the federal government the power to command a local government to perform a service to comply with a federal requirement.  This is the brief that I filed in the U.S. Supreme Court on behalf of Sheriff Sam Frank of Orange County, Vermont.
